The saga of Najib Razak continues, as a Malaysian court has just delivered a significant blow to the former Prime Minister's hopes for an early release. The court has rejected his bid to serve the remainder of his corruption sentence under house arrest. This decision underscores the complexities and controversies surrounding his case.
On Monday, the High Court ruled against the validity of a special royal order, issued by the former king, that would have allowed Najib to serve his time at home. The court found that this order didn't meet the necessary constitutional requirements. Najib's legal team has already announced plans to appeal this verdict, meaning this story is far from over.
Najib, 72 years old, is currently serving time for his involvement in the 1MDB scandal, a massive corruption case that led to his government's downfall in 2018. He was originally sentenced to 12 years in prison in 2020 for abuse of power, criminal breach of trust, and money laundering. These charges stemmed from the embezzlement of 42 million ringgit (approximately $10.3 million) from SRC International, a former subsidiary of the 1MDB fund. After losing his final appeal, Najib began his sentence in August 2022, becoming the first former Malaysian leader to be imprisoned.
In April 2024, Najib filed an application claiming that the then-King, Sultan Abdullah Sultan Ahmad Shah, had issued an addendum order that would allow him to serve his sentence under house arrest. Najib alleged that this addendum was issued during a pardons board meeting on January 29, 2024. This meeting, chaired by Sultan Abdullah, had already reduced his original sentence and significantly lowered a fine.
However, the court found that the house arrest was never discussed or agreed upon during the January 29th meeting. Judge Alice Loke emphasized that the king's power of mercy must be exercised based on the advice of the pardons board, as per the constitution. She ruled that the house arrest order was therefore invalid, as it could lead to arbitrary decisions.
This is where the story gets even more interesting. Najib denies any wrongdoing, placing the blame on Malaysian financier Low Taek Jho, who is believed to be the mastermind behind the scandal and remains at large.
But here's where it gets controversial: On Friday, the former leader will face another verdict in a separate graft trial directly linked to the 1MDB scandal. This trial involves four charges of abuse of power, where he is accused of obtaining over $700 million from 1MDB, which was then channeled into his bank accounts. He also faces 21 counts of money laundering involving the same amount. If found guilty, Najib could face up to 20 years in prison for each abuse of power charge and up to 5 years for each money laundering charge.
And this is the part most people miss: Najib established the 1MDB development fund shortly after taking office in 2009. Investigators have alleged that at least $4.5 billion was stolen from the fund and laundered by Najib's associates through various bank accounts in the U.S. and other countries. These funds were allegedly used for extravagant purchases, including Hollywood films, luxury hotels, a yacht, art, and jewelry.
The 1MDB scandal sparked a national outrage, leading to the historic defeat of the party that had governed Malaysia since its independence in 1957. Despite his conviction, Najib still holds considerable influence within his party, the United Malays National Organization, which is now part of Prime Minister Anwar Ibrahim's unity government.
